DBCYA Full members wishing to store a tender trailer at DBCYA must store it in a User-pays Tender Trailer Storage Site (site), enter into a Tender Trailer Rental Site Agreement (Agreement) and pay the applicable fees prior to occupying their Site.
-
Use of the site is for the purpose of storing a tender trailer (trailer) only. No trailer types or personal items can be stored on the site.
-
The trailer can be empty or house a yacht-related tender (up to 14ft). Stand-alone tenders can only be stored at DBCYA on the dinghy racks or boat ramp.
-
Trailers must be identified with an annual DBCYA authorization sticker (available upon joining or membership renewal) and be in working order. Trailers are not required to be registered.
-
The Agreement can be extended for further time period, upon the Trailer Owner paying the appropriate site fees (which will be automatically re-invoiced upon expiry, should the site still be occupied). The Trailer Owner shall inform the DBCYA office two weeks prior to expiry if they do not wish to extend.
-
This agreement can be cancelled at any time by either party with the provision of one month’s notice, excepting conditions listed under item 7. Any site fee balance is refundable with one month’s notice or one month in lieu. Site fees for reduced occupancy may be adjusted to the applicable fee commensurate with the actual occupancy period.
-
Trailer Owners will be assigned a numbered site within the trailer storage area. Trailer Owners can request a preferred site excepting larger trailers which will be allocated a suitable site. DBCYA reserves the right to refuse a site for oversize trailers if no suitable site is available.
-
The Trailer Owner has exclusive occupancy rights of their rented site.
-
The Agreement cannot be transferred to another party. Any transfer of ownership of a trailer stored at DBCYA must be advised to the DBCYA office and the new Owner must be informed by the existing Trailer Owner, prior to transfer of ownership, of the new Owner’s requirement to enter into an Agreement in order to facilitate continued trailer storage at DBCYA.
-
The sites are unpowered and are unsecured. Trailer Owners store their trailer at DBCYA at their own risk and should take necessary precautions against theft.
-
The Trailer Owner shall ensure their site is contained in a safe and hygienic condition to not attract and harbour vermin, mosquito or insect infestation.
-
DBCYA reserves the right to increase site rental fees from time to time with notice, applicable to any further period of occupancy.
-
Breaches of the Agreement Terms and Conditions, or failure to pay site fees in advance will result in cancellation of Agreement and the immediate requirement to remove the trailer from the site.
-
Trailers stored at DBCYA without the Trailer Owner entering into an Agreement and/or paying site fees in advance will be deemed non-compliant and may be clamped, chained, removed or disposed of, following a Two Week Notice to Rectify being placed on the trailer. DBCYA holds no liability for the action of clamping, chaining, removing or disposing of non-compliant property from its site.
-
Any related fees, costs, expenses, levies, damages, arrears due by the Trailer Owner associated with detaining, disposing, moving, and/or selling of the vessel remain the liability of the Owner.
-
DBCYA will under no circumstances be liable to the Trailer Owner for any damage, howsoever caused, to the trailer and/or its invitees while the trailer is or was situated on DBCYA property.
